Website Design Terms & Conditions
When ordering a website from Fareham Website Design the following terms and conditions listed on this page are applicable.
Definitions:
The Client: The company or individual requesting the services of Fareham Website Design.
Fareham Website Design: Primary designer/site owner & employees or affiliates
General
Fareham Website Design will carry out work where an agreement is provided by either email, telephone or in person. An ‘order’ is deemed to be a written or verbal contract between Fareham Website Design and the client, this includes telephone and email agreements.
Charges
Charges for services to be provided by Fareham Website Design are defined in the project quotation or invoice that the Client receives via e-mail. Quotations are valid for a period of 30 days. Invoices are due for payment immediately, according to the payment terms outlined below. Fareham Website Design reserves the right to alter or decline to provide a quotation after expiry of the 30 days.
Unless agreed otherwise with the Client, all website design services require an advance payment of a minimum of 50 percent of the project quotation total before the work is supplied to the Client for review. A second charge of 50 percent is required upon completion of the work, prior to upload to the server or release of materials.
Payment for services is due by bank transfer. Bank details will be made available on invoices.
Draft designs
After a deposit payment is received, Fareham Website Design will complete a draft design for review by the client. If the client is happy we will continue to complete a full design. If the client changes their mind about the design after the point of accepting the draft. Fareham Website Design reserves the right to charge addtional design costs, proportionate to the overall cost of the website agreement.
Build Times
Fareham Website Design will confirm to the client the anticipated start and finish date for their order. This date is subject to change dependant on factors such as the client delivering the required content in a timely manner. Fareham Website Design will keep the client informed at all times if there is going to be a delay. Fareham Website Design cannot be held accountable for delays which would fall under the ‘force majeure’ bracket.
Website Content
Fareham Website Design is a small business and to remain efficient we request that all clients produce and provide us with the relevant content in a timely manner. If the client is slow to provide this information, we will request that the final payment is made. Prior to completing the project.
A delay in providing Fareham Website Design with the relevant content will have a knockon effect and as such, will most likely delay the production of the clients website.
NOTE: All website content unless otherwise agreed should be delivered in ‘Microsoft Word’ format, with each page clearly labelled.
Website design
Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, Fareham Website Design cannot accept responsibility for any losses incurred due to program malfunction, the website or any part of it.
The website, graphics and any programming code remain the property of Fareham Website Design or their respective copyright holders.
Any scripts, cgi applications, php scripts, or software (unless specifically agreed) written by Fareham Website Design remain the copyright of Fareham Website Design or their respective copyright holders and may only be commercially reproduced or resold with the permission of Fareham Website Design.
Fareham Website Design cannot take responsibility for any copyright infringements caused by materials submitted by the client or otherwise. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material. We will also refuse to publish content or make changes that we deem offensive or illegal – At this point we may refuse to continue hosting your website or email.
Website Hosting
Fareham Website Design include one years website hosting with each package. Each additional 12 months hosting is charged at between £100 – £120 unless agreed at the point of sale. If a client choses not to renew the hosting fee, Fareham Website Design reserves the right to remove the website and all content from it’s servers.
NOTE: It is unlikely that this will happen. We will give you 30 days before considering website removal and deletion.
Email Hosting
Fareham Website Design includes email hosting with some of the website packages. If it is included this entitles the client to x1 email account, hosted on our servers for 12 months. Subsequent years are charged at £50 per email account.
Additional email accounts are charged at £50 each per year.
Database, Application and E-Commerce
Fareham Website Design cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.
We recommend clients do not neglect their websites and regularly check that they are performing as they should. Unless pre-agreed Fareham Website Design will not regularly check on the functionality of the website. However if a problem arises please let us know straight away and we will always try to fix it or find an alternative option.
E-Commerce websites must be hosted by Fareham Website Design our preferred host. Moving your website away from our servers, relinquishes all/any responsibility we may hold, whether additional hosting fees have been paid or not.
Web Browsers
Fareham Website Design makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Internet Explorer 8 & 9, Google Chrome, etc.). By placing an order with Fareham Website Design, clients agrees that we cannot guarantee correct functionality with all browser software across different operating systems.
Fareham Website Design do not accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website have been designed and handed over to the Client. We reserve the right to charge the Client if additional work is needed in order to work on newer and updated browser releases.
NOTE: We use WordPress and it is very unlikely that new browser updates would prevent the website form performing or displaying in the correct manner.
Extra Expenses
Fareham Website Design reserve the right to pass on additional charges incurred to the Client. For example late changes and extras that were not agreed at the point of sale.
Moving Away from us
From time to time Clients chose to move their website to hosting elsewhere. This is normally something they need help with, Fareham Website Design will charge a fee of £50 per hour in order to help the client move the website away from our servers.
Fareham Website Design will offer no refund of hosting, email or any fees if the Client choses to move their website away. We will also not provide licenses for any additional paid software or plugins used. The Client will be responsible for purchasing these independently.
Once a client choses to remove their website from our servers, this is where our responsibilty or liability ends. We cannot be held responsible for any aspect of the website or content from this point forward.
Indemnity
Fareham Website Design services may be used for lawful purposes only. You agree to indemnify and hold Fareham Website Design harmless from any claims resulting from your use of our service that damages you or any other party.
Footer Design Credit
Fareham Website Design are proud of the websites we create and as such we place our ‘credit’ in the footer area of a Clients website. If a client wishes to remove this credit, we require a fee of 10% for websites costing over £3000. Websites under £3000, we charge a smaller fee of £250.
By placing an order with Fareham Website Design the client is also agreeing to us placing images of your website within our portfolio and using them on social media etc.
Domain Names
Fareham Website Design may purchase agreed domain names on behalf of the client. Fareham Website design hold no liability over these domain names and it is the clients responsibility to insure they are renewed on time.
Fareham Website Design cannot be held accountable for loss of domain names or additional costs for renewing an expired domain if the client has not paid their renewal invoice on time.
Acceptance of Terms
Fareham Website Design consider acceptance of these terms by the Client from the point at which they make payment of any kind against an invoice sent by Fareham Website Design.
Law
This Agreement shall be governed by English Law.
